With major regulatory bodies, including the FCA, UN, IOSCO and SEC, coming out with new anti-greenwashing measures at COP26, the pressure is firmly on investors and lenders to put much greater effort into ensuring that the climate and ESG claims of investee companies and borrowers stand up to detailed scrutiny. Regulatory initiatives in this space include the establishment of the International Sustainability Standards Board (ISSB), which will replace the alphabet of different reporting standards with one rigorous yardstick, thereby facilitating comparison between different companies. The FCA’s publication of a discussion paper on UK Sustainability Disclosure Requirements (SDR) and product labels is another significant development.
Improving disclosure standards will be a major step forwards, but the thorny issues of data and ratings are more problematic. Which data are relevant? How do you obtain the data? Do you accept at face value what is provided by investee companies and borrowers? Why are the methodologies used by the burgeoning number of third-party data and ratings providers so different?
As regulation becomes more rigorous, investors and lenders will need to demand enhanced specificity, including on Scope 3 emissions, which take into account the supply chain and customer emissions of investee companies and borrowers. This will demand a much closer form of engagement and sharing of sensitive information than at present, requiring trust and a partnership approach to reducing emissions.
