The Immigration Act 2014 was amended by the Immigration Act of 2016 with the amendments due to come into force on 30 October 2017. The secondary regulations bring additional responsibilities for banks, including a requirement to undertake quarterly ‘immigration checks’ for existing current accounts.
Banks are required to conduct these immigration checks at least quarterly, with the first check needing to take place during the first quarter of 2018. There are new processes introduced for banks seeking to access the list of those without leave to stay in the UK, and for the Home Office to be notified in the case of customers being matched against the list, and to take actions in the case of a match being confirmed.
