When building on land bordered by neighboring properties, developers must ensure protections required by municipal building codes. Using a case study to illustrate the key areas of concern, this program will explore the New York City Building Code requirements for the protection of adjacent buildings, explain the technical aspects of the protections, and discuss the nature of license agreements dealing with the protections. Legal remedies available to developers in the event a neighbor does not cooperate with the implementation of the required protections will also be presented. The panel consists of attorneys with in- depth experience with neighbor agreements and an engineer fully conversant in the Code protections.
Topics will include:
• Code requirements for the protection of adjacent buildings during construction [15 minutes]
• Detailed descriptions of the types of protections to be provided to adjacent buildings [25 minutes]
• Provisions to be included in license agreements between the builder and the adjacent owner [15 minutes]
• Legal procedures available for gaining access to adjacent buildings in order to install Code protections [5 minutes]
