The panel will discuss the new Maryland state law that taxes digital advertising -- the first such state law. Advocates of taxing digital advertising believe that it justifiably generates more state revenue by taxing Big Tech, while opponents believe it violates the federal Permanent Internet Tax Freedom Act and the First Amendment. With many states working on legislation that mirrors Maryland’s new law, the question is whether the law and others that may follow will survive the significant legal challenges that they face?
