I think it will be up to the individual judge to decide, but I can certainly see some judges taking issue with the filing of any eviction papers during the moratorium period. The reality is, if you’re aggressive in evicting tenants who can’t pay, it’s going to be difficult to find tenants to re-let those units in the current economy. From a business standpoint, it may be best for landlords to work with existing tenants.
