The legal landscape for companies that operating in both the U.S. and China is changing at an unprecedented rate. Over the last year, both countries have taken significant regulatory steps impacting how companies do business: China enacted its first comprehensive data privacy law, following on the heels of a new data security law and significant new cybersecurity regulations. On the U.S. side, several federal agencies have prioritized China-related enforcement, including the U.S. Securities & Exchange Commission’s increased scrutiny of Chinese IPOs and access to company audit papers.

Meanwhile, the U.S. Justice Department continues to recalibrate China-related trade secret prosecutions and Congress is considering several significant China-related bills. Given China’s outsized role in the global economy, how should we think about these developments? What concerns should U.S. organizations that do business in China have, and how might they best react? And what impact does this new regime have on the dark side of China’s information technology?
