A two-hour webinar that pulls together the special rules relating to broker/correspondent/warehouse lending transactions.

Many financial institutions coordinate with other institutions or loan brokers in receiving applications and originating loans. Although there is, to a certain extent, natural flexibility for the parties to determine their relationship, that relationship has important consequences in determining who will be responsible for complying with lending requirements and providing various disclosures. This program focuses on the numerous compliance issues involved in brokered loan transactions from both the lender and broker perspective.

Nearly all federal lending laws and regulations, such as the Equal Credit Opportunity Act, Home Mortgage Disclosure Act, Truth-in-Lending Act, and Real Estate Settlement Procedures Act, contain special rules for those acting as brokers – and often put the responsibility for ensuring compliance on the lender. Examiners are increasingly focusing on disclosure and other compliance issues whenever an institution is involved in brokered loan transactions – whether as a broker, lender, or investor.

HERE IS WHAT YOU WILL LEARN:

• The different types of mortgage brokers and relationships;
• RESPA issues, including HUD’s statement of policy regarding brokers;
• Truth-in-Lending loan originator compensation rules;
• Disclosure responsibilities, from both the lender and broker perspective:
TRID and other Truth-in-Lending provisions;
RESPA;
Flood Disaster Protection Act;
Fair Credit Reporting Act;
Equal Credit Opportunity Act;
Private Mortgage Insurance;
Bank Sales of Insurance;
• Collection of monitoring information; and
• HMDA reporting responsibilities.

Who should attend:

All personnel involved in brokered loan transactions will benefit from this program. Compliance officers and auditors will benefit from having all compliance issues associated with brokered loans presented in a comprehensive manner.
