The formation of consortia in bidding processes, especially when they involve the participation of private players, raises competition issues of considerable importance.

Consortia have increasingly become protagonists in legal actions against companies in the infrastructure and energy sectors in Brazil. One example is the Administrative Council for Economic Defense (Cade), which is being called upon to examine the practices of companies in the maritime transport sector in the Brazilian port market. In addition, this consortium is also involved in processes related to anti-competitive practices against telecommunications companies and investigations into fraud in IT tenders.

With this in mind, the GRI Club, investors, and players in the infrastructure and energy sectors will discuss risk mitigation in the composition of consortia, considering not only financial aspects, but also ethical and compliance factors.
