A key factor to a successful project is efficient and clear contract administration; a fair payment process from entitlement to delay, prolongation and variation claims, defects, or termination; and where disputes arise, achieving a successful resolution of payment and related disputes through understanding contract rights, adjudication, arbitration or the Court. Daniel Tay will present the key legal aspects of the contract administration and payments process and provide a practical guide to these topical issues by reference to the relevant case law.

has been in practice since 2007 and represents clients in the projects and engineering, construction, and real estate sectors, advising on contract preparation, project completion, and management of disputes including private negotiations, mediation, adjudication under the Building and Construction Industry Security of Payment Act, and both international and domestic arbitration including under FIDIC, PSSCOC, REDAS, SIA or bespoke contracts, and Court litigation. Daniel’s recent notable cases include a series of successful Court decisions on disputed performance bond demands from 2014 through 2017 starting from a S$4.7 million bond demand against CCM Industrial for Eon on Shenton Way: CCM Industrial Pte Ltd v 70 Shenton Pte Ltd [2014] SGHC 75, to the most recent being a May 2017 High Court claim on the disputed validity of the bond issuer’s notice of non-renewal. Daniel in late-2016 also obtained a High Court injunction on behalf of a tunnelling contractor against a $1.2m bond demand by a main-contractor which was later set aside: Tactic Engineering (in liquidation) v Sato Kogyo [2017] SGHC 103, now pending a hearing date for an appeal filed on behalf of Tactic to the Court of Appeal.
