Platform work is a form of work in which organizations or individuals contact other organizations or individuals via an online platform to solve specific problems or to provide specific services for payment, the digital platform economy has grown rapidly in recent years.
The design of the platform directive at EU level is now becoming increasingly clear. She will definitely come.
The directive is initially intended to define the correct employment status of people working for digital platforms.
A gray area has developed for many employees regarding their employment status; many employers are not even aware that they are platform employers and are covered by the directive.
The directive is also intended to reopen and redefine the issue of the distinction between dependent employees and self-employed people, which concerns all companies.
The plan is to include a catalog of points according to which the distinction between dependent employees and self-employed people will be made.
Such a points catalog already existed in Germany in the past and the unanimous opinion was that these catalogs were not of much use.
Now the catalog will come through EU requirements. Since the said distinction between dependent employees and self-employed people is highly relevant to compliance and, if used incorrectly, can lead to criminal liability for non-payment of social security contributions or difficulties with the tax authorities, great care is required.
Ultimately, there is a discussion about including all self-employed people in the German pension insurance. This plan is met with great resistance from self-employed associations. However, it could make it much easier for companies to conclude contracts and work with so-called solo self-employed people.
