Details
As a civil law country, Monaco does not have a substantive trust law. However, Monaco enacted special legislation designed to allow foreign nationals, whose national law incorporates trust law, to create trusts in Monaco under their national law.
Trusts validly settled under foreign law are generally recognized by Monaco courts, subject to public policy considerations. Nonetheless, the case law on trusts is rather scarce and there is some uncertainty as to the treatment of trust property by the Monaco courts, especially in matrimonial and succession contexts.
