In modern times, the use of trust structures has become common practice, providing clients with flexible and tax effective ways of dealing with their assets and income. The client objectives will often be different depending upon whether they are establishing structures to conduct trading activities or merely want a ‘safe’ investment structure. But whatever the reason, it is critical that practitioners understand the trust and tax laws that govern trusts, and the current ATO view of these laws, so as to ensure that client trust structures remain effective.
