A two-hour webinar focusing on what may be unfair, deceptive or abusive acts or practices, including a review of the FDCPA. Section 5 of FTC Act prohibits institutions from engaging in unfair and deceptive acts or practices, and the Dodd-Frank Act prohibits institutions from engaging in unfair, deceptive, and abusive acts or practices with consumer financial products and services. Of course, no institution intends to be unfair, misleading, or abusive to its customers. However, given how complex our products and services can be, it can be easy to make mistakes or miss something important. Employees may feel pressure to originate or to collect outstanding amounts. This can lead to violations.
Institutions must be able to identify when and how these acts or practices occur, how to prevent and monitor them, and recognize warning signs. This webinar will review the standards of when an act or practice will be unfair, deceptive, or abusive, and review the potential subject violations in the context of collection including a review of the requirements under the Fair Debt Collection Practices Act.
