But Michael Benza, a criminal law professor at Case Western, said it was up to the prosecutor to decide. He said “there are a lot of problems” with the prosecutor’s case, including the definition of a human corpse. But the prosecution’s biggest challenge might be in the vagueness of the language. “If my students wrote this statute,” he said, “they would fail.”
