  • "Often, lenders think UCC filings fall into the “set it and forget it” category for a lender. Once it has been filed, a lender may assume that they can concentrate on their other work, thinking their interest is protected. But that is not the case. A lien may not hold up if it was not filed with the absolute correct name (even an extra space in a name or a period can make a difference). If a lien was filed in an incorrect jurisdiction, or if a debtor moved or changed their name again, the lien may not be effective." ABA Banking Journal, June 2020)

  • "Lien management affects a financial institution’s risk profile in a significant way and, accordingly, should be a part of a risk officer’s daily agenda. Historically, liens have been viewed as binary, i.e., they were considered to be either secured or unsecured, so the complexity that exists with liens was not even on lenders’ radars. But locating the loan review process within a bank and seeing how lien perfection is managed can provide useful insights about how and where a bank is vulnerable to risk." (ABF Journal, January 2023)
